Felony DUI Charges

Felony DUI in Orange CountyA felony DUI allegation has extremely serious consequences that only an experienced DUI attorney should handle. The consequences are so severe that every technical aspect of the case should be analyzed in order to find a defense or mitigating circumstances that may save your future from severe repercussions. Not only is the threat of a prison sentence a possibility, but severe driver's license consequences are also a reality.

The Law
A felony DUI occurs in two circumstances: 1) the person has 3 prior DUI or DUI related-convictions within 10 years of the present arrest; or 2) an accident occurred and someone was injured or killed. When an accident occurs, great bodily injury, multiple victims, mayhem, manslaughter and/or murder allegations maybe filed.

The Criminal Consequences
If a felony DUI is charged, and no other charges are filed (such as allegations of great bodily injury, multiple victims, manslaughter, murder) the maximum sentence is 3 years in prison. However, the maximum could be the possibility of up to a life sentence if someone dies.

The Driver's License Consequences
If a felony DUI conviction results from the present offense and the person has three previous convictions within 10 years or there was an accident and someone was injured (but not killed), DMV will suspend the person's driver's license for one year.

If a felony DUI conviction results from the present offense and someone dies as a result of an accident, the DMV will revoke the driver's license for one to three years depending on the type of conviction charge.

Although a conviction will result in a driver's license suspension or revocation, the DMV may also suspend or revoke the driver's license through their Administrative Per Se Process. You are entitled to a DMV Hearing and need to make that request within 10-days from the date of the arrest.
