Arreste for a Domestic Violence Charge in Orange County California?YIf you have been accused of domestic violence in Orange County, you need to speak to an attorney about your rights, defenses and important criminal procedures that will affect your future. The process happens quickly as an arrest, most often, occurs immediately; a temporary restraining order may be issued at the scene or by the Judge at the first court hearing; and you may lose the right to live in your house or see your children.

When a dating relationship, marriage or past dating or marriage has occurred, the parties fall under the general term of domestic violence. Domestic violence is charged by the Orange County District Attorney's office in many ways.

The simplest forms of domestic violence, commonly charged as misdemeanors are:

  • Assault (Penal Code section 240) - a minor threat of injury to another
  • Tampering with a phone line (PC 591) - not allowing another to use the phone or breaking a phone
  • Disturbing the Peace (PC 415) - the charge describes the act
  • False Imprisonment (PC 236) - not allowing another to freely move
  • Domestic Battery (PC 243(e)(1)) - the unlawfully touching of another without injury

The following charges may either be charged as misdemeanors or felonies in Orange County depending on the seriousness of the actions:

  • Criminal Threats (PC 422/245) - a threat to do great bodily injury or death
  • Domestic Battery (PC 273.5) - unlawful touching that results in injury

Felonies are charged when the threat is great, serious, and there is a likelihood that the threat will be acted upon; where the injury is great; or where the person has a previous instance of domestic violence. The felony charge can be as simple as a criminal threat or as complicated as a rape.
